EU family member residence card: rights and processing in Spain
Types of EU family member residence card
The EU family member residence card (TRF-UE) is the legal instrument recognising the right of residence of family members of EU citizens in Spain, regulated by Royal Decree 240/2007 and EU Treaties. Two categories exist: (1) Initial residence card (art. 10) — valid 5 years, renewable while family ties and EU citizenship of sponsor persist; (2) Permanent residence card (art. 20) — indefinite status after 5 years of continuous legal residence as EU family member.
Rights and processing
The card covers spouse, registered same-sex partner, dependent children under 21, and dependent ascendants of the EU citizen. Processing time is 30 days from application to the Immigration Office (Oficina de Extranjería), though real timelines range 45–90 days depending on office volume.
Once issued, the TRF-UE holder has equal access to the Spanish labour market as Spanish citizens, with no sectoral or geographic restrictions.
At Eon Legal, we manage the complete cycle: eligibility review, document coordination (marriage, registered partnership, proof of dependency), filing with Immigration Office, handling of 5-year renewals, and support for transition to permanent residency.
