Spain's 2026 extraordinary regularisation: Mercurio filing & UTEX processing
The Royal Decree on extraordinary regularisation 2026 is a threefold-legitimacy initiative opening a unique window until 30 June 2026 for thousands of migrants already living in Spain to access a one-year residence and work permit, Social Security affiliation number, and public health card of their region of residence. The initiative has social legitimacy (backed by >700,000 signatures from Popular Legislative Initiative plus ~900 civil associations), political legitimacy (parliamentary approval), and economic legitimacy (explicit endorsement from employer federations and trade unions for strengthening worker rights and employment security).
The process is centralised with Spain's Immigration Case-Handling Unit (UTEX) via the single Mercurio platform operated by the Ministry of Inclusion, Social Security and Migration: online filing available 24/7 from 16 April, in-person appointments from 20 April, deadline 30 June 2026 (non-extendable). Administrative silence operating positively (no express resolution within statutory timeline) automatically grants the permit under Article 24 of the Common Administrative Procedure Act. Processing typically takes 3–6 months from filing to resolution or silence.
The issued permit — or presumed by administrative silence — grants 12 months validity plus immediate access to full labour market without sectoral restrictions and automatic Social Security enrollment. At year-end, the status converts to ordinary Immigration Regulations routes (employee residence, self-employed, long-term, family) provided continuous work or integration ties are evidenced.

- Combination of public and private documents for complete coverage from before 1 January 2026
- Social legitimacy documentation — continuous padrón records plus community arraigo certificate or witness declarations
- Political legitimacy documentation — certificate from Police Directorate General of asylum application or international protection status, provisional reception resolution
- Economic legitimacy documentation — pay slips, employment contracts, Social Security registration confirmation or proof of affiliation and contribution history
- Valid passport or travel document and legible
- Completed application form per UTEX instructions on Mercurio platform (available Spanish and English)
- Passport-style photograph (DGT technical specifications)
- Application filed before 30 June 2026 (non-extendable): online 24/7 via Mercurio, or in-person at Immigration Office by prior appointment
- If UTEX issues administrative request: respond within maximum 10 business days with additional documentation or clarification

- If UTEX does not issue an express decision within the legal timeframe, administrative silence is positive: the initial residence and work permit is deemed granted. You do not need an express resolution to begin working legally in Spain.
